Terms of Service
Last updated: September 21, 2026
Thanks for playing Guessr. These Terms of Service are the agreement between you and Guessr, LLC covering your use of our games and websites, and they work together with our Privacy Policy. We've kept them as readable as a legal document allows, but they are still a contract, so please give them a proper read.
By using our Services, whether as a visitor or in any other way, you're agreeing to these Terms. If there's anything in them you can't accept, the only option is not to use the Services.
1. Definitions
A few words carry specific meanings throughout these Terms:
"Guessr," "we," "us," and "our" mean Guessr, LLC, together with each of its subsidiaries, parent companies, joint ventures, and other corporate entities under common ownership, and any of their agents, consultants, employees, officers, and directors. Our Affiliates and other third parties (analytics or advertising technology companies, for instance) are not included.
"Affiliates" means our third-party content providers, distributors, licensees, and licensors.
"Services" means every website, application, and distribution channel that we or our Affiliates operate, including, without limitation, https://guessr.com/ with all of its subdomains and sub-pages, and any official social media or video channels we run.
"Content" means material we produce and make available through the Services, whether on the website or through any official social media or video channels we run.
"Intellectual Property Rights" means every right, title, and interest of any kind, whether known today or not and whether registrable or not, in and to patents, trade secret rights, copyrights, trademarks, service marks, trade dress, and comparable rights of any type under the laws of any governmental authority, including, without limitation, every application and registration connected with any of them.
"Dispute" means any controversy connected with this agreement, including, without limitation, claims arising from or relating to any aspect of the relationship between you and us, claims that predate this agreement, and claims that arise after it ends. It does not include claims connected with enforcing or protecting Intellectual Property Rights, and it remains subject to any statutory consumer rights laws that apply where you live.
"Notice" means a writing delivered by e-mail, taking effect once the other party receives it. Notice to us goes to support@guessr.com. Notice to you goes to any e-mail address you have given us.
"Privacy Policy" means our privacy policy, which also governs your use of the Services and forms part of these Terms by reference. The current version is always at https://guessr.com/privacy.
"Terms of Service" or "Terms" means this agreement.
2. Ownership and Your License to Play
- What we own. We own the Services, or hold licenses to them, and they're protected by Intellectual Property Rights and other proprietary rights laws. Every right, title, and interest in the Services that these Terms don't expressly grant to you, including, without limitation, all Intellectual Property Rights and other proprietary rights, stays with us. Our Intellectual Property Rights set the boundaries of what you're permitted to do with the Services.
- What you can do. As long as you accept and keep to these Terms and any other policies of ours that apply, we grant you a limited, revocable, non-exclusive, non-transferable, non-commercial license, subject to the restrictions in these Terms, to access and use the Services for your own entertainment and information. Please don't use them for anything else.
- Where the line is. Using the Services in a way that breaks the law, these Terms, or the restrictions below is not allowed. If you do, we may revoke your license immediately, in our sole judgment, and you may also be liable under the law.
Specifically, you agree that you won't, directly or indirectly:
- Do anything we consider contrary to the spirit or purpose of the Services;
- Copy, modify, edit, build derivative works from, publicly display, publicly perform, republish, transmit, or distribute the Services or any other material you obtain through them;
- Rent, lease, sell, or otherwise commercially exploit any part of the Services, including, without limitation, access to or use of them;
- Remove, change, or hide any Intellectual Property Rights notices or other proprietary rights notices on material taken from the Services;
- Attempt to harass, threaten, bully, embarrass, abuse, or harm anyone, any group, us, or our Affiliates, or advocate or incite any of that;
- Organize or take part, in connection with the Services, in any activity or group that is hateful, harmful, or offensive toward a race, sexual orientation or preference, religion, heritage or nationality, disability or other health class, gender, age, or comparable class we identify;
- Start, assist with, or take part in any attack on or disruption of the Services, including, without limitation, spreading a virus, worm, spyware, time bomb, or corrupted data, mounting denial of service attacks, or otherwise interfering with the Services or with anyone else's use and enjoyment of them;
- Use robots, spiders, crawlers, man-in-the-middle software, or any other automated process to access, use, reverse engineer, or manipulate the Services or us;
- Use the Services to obtain, generate, or infer business information about us or our Affiliates, including, without limitation, information about sales, revenue, employees, or user statistics;
- Promote, encourage, or take part in hacking, phishing, distributing counterfeit Services, or exploiting or creating exploits, cheats, bugs, or errors, other than to report them privately and directly to us, which we'd really appreciate;
- Make available through the Services anything that infringes an intellectual property right, right of privacy, right of publicity, or other right of any person or entity, or that impersonates anyone, including, without limitation, celebrities and the people who work for us;
- Try to gain unauthorized access to the Services; or
- Use the Services anywhere the law prohibits it.
3. Term
- These Terms, and each provision in them, stay in full force and effect unless we modify or amend them. If we terminate any license granted under these Terms, the rest of the agreement is unaffected.
4. Eligibility
- By using the Services, you promise (in legal terms, you represent and warrant) that you're at least 13 years old, or older if the law where you live sets a higher minimum age for using online services without a parent's consent, and that you're legally able to read, understand, and accept these Terms.
- If you meet the age in Section 4(1) but are still a minor where you live, you may use the Services only with your parent's or legal guardian's permission. They accept these Terms on your behalf and are responsible for your use of the Services.
- If we've banned you from any of our Services before, you can't use them now.
- You also represent and warrant that you're not located in a country subject to a United States government embargo, or one the United States government has designated a "terrorist supporting" country, and that you don't appear on any United States government list of prohibited or restricted parties.
5. Availability and Termination
-
You understand and agree that:
- We may release amendments, new versions, enhancements, modifications, upgrades, or patches to any part of the Services whenever we choose, at our sole and absolute discretion;
- We may terminate or restrict access to the Services, or any part of them, immediately, at any time, for any reason, without Notice, and without liability to you, at our sole and absolute discretion;
- Access may be interrupted for reasons both within and beyond our control, and we can't and don't guarantee that the Services will be available whenever you want them;
- We may choose not to offer the Services in every country or region.
-
You are responsible for any internet or mobile data charges you incur while using the Services.
6. Intellectual Property
- Everything in the Services belongs to us or to our third-party suppliers, or is used lawfully under a license agreement. That includes, without limitation, the text, graphics, logos, images, code, and other materials, their compilation, and the look and feel of the Services. All of it is protected by copyright, trademark, and other laws safeguarding intellectual property and proprietary rights. You agree to respect and comply with every copyright, trademark, and other proprietary notice, legend, or restriction in that content, and not to alter any of them.
- You won't modify, publish, transmit, reverse engineer, take part in the transfer or sale of, create derivative works from, or otherwise exploit any content provided on, transmitted through, or found within the Services, in whole or in part. Using the Services gives you no right to make unauthorized use of it, and in particular you must not remove or alter any proprietary rights or attribution notices within it. Content from the Services is for your personal use as described in these Terms and nothing more, unless we and any relevant third-party owner give you express written permission. You don't gain any ownership rights in content provided through the Services, and apart from what these Terms expressly grant, no license to that content, or to any other intellectual property of ours, our licensors, or any third-party owner, is given, whether express or implied.
- The song previews, artwork, and song information you see and hear come from third-party rights holders and content providers. They remain those owners' property and may be used only within the Services as part of play.
7. Links to Other Sites
The Services may link to websites run by other people ("Linked Sites"). We don't control them. We're not responsible for what a Linked Site contains, including, without limitation, any link inside it or any change or update made to it. We include links purely for your convenience, and a link doesn't mean we endorse that site or have any association with whoever runs it.
8. Disclaimer, Warranty, and Liability
This section is in capital letters because the law expects disclaimers like these to stand out. The short version: the Services come as they are, and our liability to you is limited as far as the law allows.
YOU ACKNOWLEDGE THAT NEITHER WE NOR OUR AFFILIATES ARE LIABLE
(1) FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, GOODWILL, OR DATA, HOWEVER ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICES; OR
(2) FOR THE CONDUCT OF ANY THIRD PARTY, INCLUDING OTHER USERS OF THE SERVICES AND THE OPERATORS OF EXTERNAL SITES.
WE PROVIDE THE SERVICES ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE GIVE NO WARRANTY OR REPRESENTATION OF ANY KIND, WHETHER EXPRESS OR IMPLIED, ABOUT HOW THE SERVICES OPERATE, EXCEPT WHERE SUCH WARRANTIES OR OTHER STATUTORY CONSUMER RIGHTS CANNOT LAWFULLY BE EXCLUDED OR LIMITED WHERE YOU LIVE. YOU BEAR THE ENTIRE RISK OF USING THE SERVICES, INCLUDING ANY RISK OF INJURY ARISING FROM THEM. TO THE FULLEST EXTENT THE LAW PERMITS, WE DISCLAIM EVERY WARRANTY, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE FULLEST EXTENT ANY APPLICABLE LAW ALLOWS, THESE DISCLAIMERS OF LIABILITY COVER ALL DAMAGE OR INJURY CAUSED BY THE SERVICES, OR CONNECTED WITH USING OR BEING UNABLE TO USE THEM, UNDER ANY CAUSE OF ACTION IN ANY JURISDICTION, INCLUDING, WITHOUT LIMITATION, ACTIONS FOR BREACH OF WARRANTY, BREACH OF CONTRACT, OR TORT (NEGLIGENCE INCLUDED).
TO THE MAXIMUM EXTENT APPLICABLE LAW PERMITS, THE TOTAL LIABILITY OF GUESSR AND OUR AFFILIATES ARISING FROM OR CONNECTED WITH THIS AGREEMENT WILL NOT EXCEED THE TOTAL AMOUNT YOU PAID (IF ANY) TO US OR OUR AFFILIATES IN THE ONE HUNDRED AND EIGHTY (180) DAYS IMMEDIATELY BEFORE THE DATE YOU FIRST ASSERT THE CLAIM.
IF YOU PAID NOTHING TO US OR ANY AFFILIATE IN THE ONE HUNDRED AND EIGHTY (180) DAYS IMMEDIATELY BEFORE THE DATE YOU FIRST ASSERT THE CLAIM, YOUR ONE AND ONLY REMEDY FOR ANY DISPUTE WITH US OR ANY AFFILIATE IS TO STOP USING THE SERVICES.
SOME STATES, COUNTRIES, AND JURISDICTIONS DON'T ALLOW THE EXCLUSION OF PARTICULAR WARRANTIES, OR THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. THERE, THE LIABILITY OF GUESSR AND OUR AFFILIATES IS LIMITED TO THE MAXIMUM EXTENT APPLICABLE LAW PERMITS, SUBJECT TO ANY STATUTORY CONSUMER RIGHTS LAWS THAT APPLY WHERE YOU LIVE.
9. Indemnity
-
You agree to defend, indemnify, and hold harmless Guessr, our Affiliates, and any third party under agreement with us, together with every employee, contractor, vendor, agent, supplier, licensee, customer, distributor, shareholder, director, and officer of any of them, as well as any person who uses the Services and any person or entity that at any time becomes aware of your use of the Services, from and against any and all claims, liabilities, judgments, awards, injuries, damages, losses, costs, fees, and expenses (including, without limitation, attorneys' fees and costs) arising under, from, or in any way relating, directly or indirectly, to:
- Any failure on your part to comply with a provision of these Terms;
- Your use of the Services, including, but not limited to, economic, physical, emotional, psychological, or privacy-related matters; and
- Any knowing action on your part to affect the Services through bloatware, malware, a computer virus, worm, Trojan horse, spyware, adware, crimeware, scareware, rootkit, or any other program installed so that its executable code is scheduled to use, or does use, processor cycles while the program isn't being directly or indirectly used.
-
We and our Affiliates reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, though we are never obliged to do so.
-
We have no duty to defend, indemnify, or hold you harmless in any matter connected with this agreement, including, but not limited to, your use of the Services, anyone else's use of the Services, or any connection between those and any other person or entity that at any time becomes aware of your use of the Services.
-
This Section survives the termination of these Terms.
10. Resolving Disputes
We'd much rather sort out a problem with a conversation than a proceeding, so this section starts there.
-
Informal resolution first. For any Dispute, you agree to attempt to resolve it with us informally for at least thirty (30) days before commencing arbitration or any other proceeding, including a proceeding in court or before an administrative agency. That period begins when we receive Notice from you, as Section 1 defines that term, and your Notice must set out your name, the e-mail address or other contact details at which we can reach you, the nature and basis of the Dispute, and the specific relief you seek.
-
Then binding arbitration. If you can't resolve a Dispute informally to your satisfaction within thirty (30) days in total, or if we decide, at our sole and absolute discretion, that a satisfactory informal resolution within thirty (30) days in total will not be possible, you agree that either of us may ask for the Dispute to be resolved through final and fully binding arbitration held in Williamson County, Texas under the Commercial Arbitration Rules of the American Arbitration Association. Whoever asks for arbitration under this Section is responsible for starting it.
- The American Arbitration Association ("AAA") will administer the arbitration between you and us, applying AAA's rules and procedures (including, where applicable, its Consumer Arbitration Rules). Where anything in these Terms differs from AAA's rules and procedures, these Terms govern. AAA's rules and procedures are on its website at www.adr.org, or you can call +1 (800) 778-7879.
- YOU UNDERSTAND AND AGREE THAT YOU MAY CONSULT INDEPENDENT LEGAL COUNSEL OF YOUR OWN CHOICE ABOUT THIS AND EVERY OTHER PROVISION OF THIS AGREEMENT, AND THAT THIS BINDING ARBITRATION PROVISION REMOVES YOUR LEGAL RIGHT TO SUE IN COURT, TO HAVE A JURY TRIAL, AND/OR TO TAKE PART IN A CLASS ACTION IN RESPECT OF ANY SUCH DISPUTE. You and we each agree not to try to join any other arbitration or class action involving any other party to an arbitration between us. To the fullest extent the law permits, no arbitration will be decided on a class-action basis or by using class action procedures. Each of us may bring claims against the other only in an individual capacity, and never as a plaintiff or class member in any purported class or representative proceeding.
11. Everything Else
- Changes. It's up to you to read, understand, and accept these Terms in connection with your use of the Services. We may change them at any time, and the section headings are here for convenience only. Unless we say otherwise, changes take effect once they're posted. If you keep using the Services after that, you're agreeing that the changed Terms govern your continued use and that continuing counts as accepting them. It's worth checking this page now and then.
- Complete agreement. This agreement: (1) is the final and complete agreement and understanding between us regarding its subject matter, and supersedes and replaces every prior and contemporaneous agreement and understanding on that subject; (2) can't be changed, amended, or modified in any way by you except in a writing signed by the authorized agents of both parties; (3) can't be assigned, except to a successor in interest to substantially all of a party's business or assets, and any other attempt to assign or transfer it or any interest in it is void; and (4) binds and benefits both of us and our respective heirs, executors, administrators, successors, personal representatives, licensees, and assigns.
- Force majeure. Neither party is responsible for delay or failure in performance caused by events beyond its reasonable control, including war, terrorism, acts of public enemies, strikes or other labor disturbances, power failures, fires, floods, earthquakes, acts of God, and other natural disasters.
- Waiver. Nothing we do or don't do counts as waiving a right under this agreement unless we waive it in writing, signed by one of our officers. Expressly waiving one provision doesn't waive any other, and it doesn't waive that provision for the future either.
- Severability. If any provision or sub-provision of this agreement is held invalid or unenforceable, the rest is enforced as fully as possible, and the unenforceable part is treated as modified only as far as needed to make it enforceable in the way that most closely reflects what we both intended here.
- Remedies. You acknowledge and agree that any breach or threatened breach of this agreement would cause us irreparable harm, so we may seek injunctive relief without having to prove actual damages, on top of every other remedy available at law or in equity. You specifically acknowledge that money alone wouldn't adequately remedy the injury and damage we'd suffer from a breach of any provision of this agreement.
- Governing law and venue. Every dispute or claim arising from or connected with this agreement is governed by and interpreted under the laws of the State of Texas, without regard to any choice or conflict of laws principles. Except where a matter goes to arbitration under Section 10, the Courts of the State of Texas have exclusive jurisdiction over every legal suit, action, or proceeding arising from or relating to disputes or claims under this agreement. We each consent to the personal jurisdiction of the Courts of the State of Texas and waive every jurisdictional or venue defense that might otherwise be available.
- Language. To the fullest extent the law permits, English is the controlling language of these Terms.
